Terms and Conditions

These Terms and Conditions govern your use of the Terra app ("Application") developed by Ramesh Cinnaiyann ("Service Provider") as a Freemium service. By downloading or using the Application, you agree to these terms. Please read them carefully before use.
1. Acceptance of Terms
By accessing or using the Application — including as a guest without an account — you agree to be bound by these Terms. If you do not agree, do not use the Application.
2. Intellectual Property
All trademarks, copyrights, database rights, source code, design, and other intellectual property related to the Application remain the sole property of the Service Provider. You may not:
- Copy, modify, or create derivative works of the Application
- Attempt to extract or reverse-engineer the source code
- Use the Application's name, logo, or branding without written permission
3. User Accounts
- You may use the Application as a guest (anonymous session) with limited features
- Guest sessions are automatically deleted after 3 days of inactivity
- To access full features, you must create an account with a valid email address or Google Sign-In
- You are responsible for maintaining the confidentiality of your account credentials
- You must be at least 13 years of age to create an account
Account deletion: You may request deletion of your account and all associated data by contacting rameshdevwork@gmail.com. All data will be permanently deleted from our servers upon request.
4. Subscription and Billing
The Application offers a free tier ("Sprout") and a paid subscription tier ("Bloom"):
- Subscription pricing and features are displayed within the Application at the time of purchase
- Subscriptions are processed through RevenueCat and billed via Google Play
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period
- You may manage or cancel your subscription through your Google Play account settings
- Refunds are governed by Google Play's refund policy. The Service Provider does not directly issue refunds
- Upon subscription expiry, your account reverts to the free Sprout tier and paid features become inaccessible. Your data is retained.
5. Usage Limits
- Free users are limited to 5 plant identification scans per day
- The Service Provider reserves the right to adjust these limits with reasonable notice
- Attempting to circumvent usage limits (e.g., creating multiple accounts) is a violation of these Terms and may result in account termination
6. Plant Care Disclaimer
This is the most important clause for your legal protection.
The Application provides plant care guidance (watering schedules, species identification, care recommendations) for informational purposes only. This information is:
- Generated from third-party databases (Open Plantbook), AI models (Google Gemini), and automated rule engines
- Not a substitute for professional horticultural advice
- Based on general species data and may not account for your specific environment, plant health, or local conditions
The Service Provider accepts no liability for plant damage, death, or loss resulting from following the Application's recommendations. Use your own judgment and consult a professional for valuable or specialist plants.
7. Artificial Intelligence
The Application uses AI technologies in the following specific ways:
- Plant identification: Your photos are sent to PlantNet API and Google Gemini to identify plant species
- Care recommendations: Google Gemini may generate care data for species not found in our primary database
AI-generated results may not always be accurate. The Service Provider does not guarantee the correctness of any AI-generated identification or recommendation. Always verify identification of plants that may be toxic or harmful.
8. Third-Party Services
The Application integrates the following third-party services, each governed by their own Terms:
The Service Provider is not responsible for the actions, content, or policies of these third-party services.
9. Acceptable Use
You agree not to:
- Use the Application for any unlawful purpose
- Attempt to gain unauthorised access to any part of the Application or its infrastructure
- Submit false, misleading, or harmful content
- Use automated tools to abuse the Application's API or scan quota system
- Jailbreak or root your device in ways that compromise the Application's security
10. Disclaimers and Limitation of Liability
- The Application is provided "AS IS" without warranties of any kind
- The Service Provider does not guarantee uninterrupted or error-free operation
- The Service Provider relies on third-party APIs (PlantNet, Open Plantbook, Gemini) for core features. Downtime or changes to these services may affect Application functionality
- To the maximum extent permitted by applicable law, the Service Provider's total liability to you for any claim arising from use of the Application shall not exceed the amount you paid for the Application in the 12 months preceding the claim
- The Service Provider is not responsible for data charges incurred by your mobile provider while using the Application
11. Termination
By you: You may stop using the Application at any time and request account deletion as described in Section 3.
By the Service Provider: The Service Provider reserves the right to suspend or terminate your access if you violate these Terms, with or without notice. Upon termination, your right to use the Application ceases immediately.
12. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Tamil Nadu, India. EU users retain any statutory rights granted under applicable EU consumer protection law.
13. Changes to These Terms
The Service Provider may update these Terms periodically. You will be notified of material changes by an update to the effective date at the top of this page. Continued use of the Application after changes constitutes acceptance of the updated Terms.
